Denied Life Insurance Claim Attorney
New York, New Jersey & Massachusetts
Many people purchase life insurance policies to help ensure their family’s well-being in the future. A life insurance policy is a contract between the policyholder and the life insurance company, stating that if the policyholder passes away, the life insurance company will pay the policyholder’s beneficiaries a certain amount of money.
Part of the life insurance policy, and therefore the life insurance contract, is the life insurance policy application. When a person applies for life insurance, the life insurance company reviews the application and determines if it will ensure the person, and if so, the amount of coverage it will provide, and the amount of the premium it will charge. If a person is approved for life insurance, the person then designates specific individuals, who can be family members or others, who would receive the insurance payment owed by the insurance company if the policyholder passes away. Such individuals are known as the beneficiaries of the life insurance policy.
Once an insured passes away, the beneficiary can file a claim with the life insurance company for payment owed according to the policy. However, life insurance companies can – and do – deny coverage under certain circumstances. Common reasons given for life insurance coverage denials are that the policyholder made a material misrepresentation on the policy application, that the policy had lapsed, or that the person seeking payment was not designated as a beneficiary. These issues are explained in more detail below.
